AI Project Participation Terms

Terms of participation in the development project of the "HelpClinic" application using an artificial-intelligence model.
Definitions
- Application β the web application named "HelpClinic", made available by the Provider to Participants via a mobile app.
- Provider β "HelpClinic" sp. z o.o., registered office in ΕΓ³dΕΊ, ul. Ogrodowa 8, 91-062 ΕΓ³dΕΊ, Poland, entered in the Register of Entrepreneurs under no. 0001205338, REGON: 54324420400000, NIP: 7252361439, share capital PLN 250,000.
- Participant β a natural person at least 18 years old with full legal capacity, using services provided through the Application.
- Profile data β the Participant's personal data collected while using Consultations and other Application services / features, including survey, interview and test results, the course and results of using Support tools, and the course and results of Consultations.
- AI Model β an artificial-intelligence model systematically trained using source materials available to the Provider, including Profile data shared by Participants, to continuously develop the Application and improve / add services, tools and features.
- Training database β a database containing Profile data stripped of data identifying the Participant (name, surname, email, phone number, or other such data), serving as source data for training the AI Model. The Provider owns the Training database; it is used solely for machine-learning operations supporting the Application's Development work.
- Development work β the Provider's work to develop the Application and improve / add new services, tools and features, carried out using the Training database.
- Specialist β a qualified psychologist or psychotherapist employed by the Provider, providing remote psychological / psychotherapeutic support to the Participant during Consultations through the Application.
- Consultation β a psychological / psychotherapeutic consultation conducted remotely by a Specialist (video consultation), as an Individual or group Consultation.
- Support tools β features or interactive applications for the Participant's independent use, focused on development, well-being, quality of life and stress support (e.g. journals, tutorials, audio files and the AI Chat).
- AI Chat β a feature within Support tools that uses an artificial-intelligence model.

I. General information
This document is addressed to Participants using the "HelpClinic" Application and sets out the purpose and rules for participating in the Application's development project using an artificial-intelligence model (the "Application Development Project"). Terms matching those defined in the Terms of service for the Application are to be understood as defined there.
II. Purpose of the Application Development Project
The Provider's intention is to continuously develop the Application's features and services, including using an artificial-intelligence model (AI Model). The Provider makes every effort to ensure that AI Model training is based on valuable, substantively relevant data, so that services and features can be precisely tailored to Participants' individual needs.
Based on your consent, your Profile data from various Application features may be transferred to the Training database β e.g. from the Questionnaire, from Support tools (including tests, surveys, interviews, journals, the AI Chat), and from Specialists' Notes describing the course and results of Consultations.
The Provider does not intend to track Participants' personal experiences or life situations. Therefore, with the Participant's consent, Profile data will be moved to a separate Training database without data that directly identifies the Participant (such as name, surname, email, phone number). The Training database thus built serves as source data for training the AI Model, allowing the Provider to continuously improve the Application's services and build new ones.
III. Rules of participation
- Participation is entirely voluntary. It involves the Participant consenting to the use of information from Profile data β including from Consultations and information on their course and results β to train the AI Model within Development work, to improve the Application's features and Specialists' services. Detailed consent rules are in the Privacy Policy.
- If the Participant does not consent, their personal data will be used solely to perform the Application's Electronic services ordered by them.
- To document consent to transfer Profile data collected during Consultations to the Training database, the Provider makes a written consent form available in the Application, which the Participant signs and sends to: "HelpClinic" sp. z o.o., ul. Ogrodowa 8, 91-062 ΕΓ³dΕΊ.
- Participation is free of charge and may be joined at any time.
- You may withdraw at any time, without giving a reason, by revoking consent to the use of your personal data, including Profile data. This requires sending a written statement to the Provider's registered office (ul. Ogrodowa 8, 91-062 ΕΓ³dΕΊ) or to: gdpr@helpclinic.com.
- The Provider reserves the right to end the Application Development Project at any time and to amend these Terms of participation. Changes do not affect rights already acquired by the Participant or the scope of consent already given. The Provider gives at least 7 days' notice of changes, via the Application or email.
IV. Complaints. Data-processing rights
Complaints about participation can be submitted in writing to the Provider's registered office (ul. Ogrodowa 8, 91-062 ΕΓ³dΕΊ) or to: gdpr@helpclinic.com. The Provider will respond promptly, no later than 14 days from receipt. The Participant's data-protection rights are detailed in the Privacy Policy and are exercised independently of the complaints procedure.
V. Final provisions
These Terms of participation are governed by Polish law. Matters not regulated here are governed by the Civil Code, the GDPR, the rules governing the profession of psychologist or psychotherapist, or other applicable Polish law.
